What would you do if car was wrecked by someone?
Problem: I bought a car from a used car dealership in VA. The owner/operator had an existing loan on the car (car has a lien on it) that I was unaware of. Its been three months and the person has not titled the car to me (probably because they can't), the car is not registered to me. I have no title, reg, or plates. No temp plates were given. The owner let her personal plates on the car. The paperwork was inaccurate and the seller has admitted that she filled out the paperwork wrong in writing. The car was wrecked by a friend in Oct. My insurance finally decided to cover the car because I had the insurance on the car and was waiting for the titling. It took them awhile to decide. When I added the car to my insurance they said that they receive lien information from DMV. They wanted the car, but I nor did the seller have the car. They offered $3500 and I kept the car. It isn't enough to get the car fixed, so I got a new car. I didn't want to walk away empty handed. So, what do I do now?
I contacted a lawyer who said they believe it is fraud and to let the police handle it. DMV is doing an investigation. The dealer board stated that I must go to small claims court to have the deal null and void.The lawyer says it will be costly to take this to court. The dealer says if I get the car fixed, she will give me a refund. What should I do? I can't repair the car with the amount given from insurance. I feel that she is responsible for this because if I had access to the title she could have just been paid off. She owes more on the car than I owe her. I do, however, feel some responsibility because my friend did wreck her car. What should I do? Or rather, what would you do?
