What are the legal ramifications for a cheating car dealership? What can I expect in a law suit, and can they?
Last year I was sold a used automobile that had been an unmaintained fleet car. The odometer and fuel gauge were incorrect, broken and on-recall (facts not known then). The dealership wrote me three contracts for the car over a two month period because they could not find financing, then tried to rescind the deal after 30 days. They did not follow procedure in this either. I reported them to the Dept. of Motor Vehicles and was told it was a civil matter, and to get an atttorney. I did. Now we are in a settlement mediation and my attorney has left me to determine what I might settle for. I am clear about about the expenditures I might ask reimbursement for, but I don't know how to valuate the "bait and switch," illegal contract writing, sale of the undisclosed fleet history, or the false odometer reading. I suffered anxiety and stress that compounded a medical condition.
The dealership has put $5000.00 on the table, but I would like $30,000. Is this reasonable? How do I figure the damage and losses? Is the dealer in any way indictable? By the way, the attorney gets 45% of settlement.
Thak you for your support--Winner and Outsider. I am just trying to see if I missed anything and if I have options beyond those I shared. The mediation is forced by the car contract which said if I had a problem I would accept mediation. So, I don't know if juried recourse is an option.

I thank the first three of you who responded. You help me to get a clear picture of my position. I'm not sure that if I explained all of the minor details it would help. But they did break the law. They knew the car had been a fleet car, but didnot disclose(Carfax) and they offered me a trade based on my former credit with them for a previous auto purchase. They tore up the contract without the proper disclosure paper work, and the problem was I lived out of town and had to run back and forth. The attorney has done minimal work but, it was what I could not do. His contract does say 45%. It seems very high, but I accepted that. It's just that I want these guys to be held accountable by law,and I want a subtantial settlement.
